Politics: The Supreme Court Leak

In what is likely my last Supreme Court related blog post for a while, I’m going to talk about one of the most unusual news stories of our time. There were other topics that I wanted to get into instead of this one, but those will have to wait until the next vacancy on the court.

By now, you’ve probably heard about how how the court opinion that could overturn Roe versus Wade has been leaked with it appearing that Roe versus Wade was overturned. Sadly, there has probably not been any news coverage of potential good aspects of Roe being overturned. In addition to saving countless lives, good affects of this would be: 1- voter increase for liberals, 2- voter decrease for conservatives, 3- the end of the belief that there shouldn’t be liberal judges on the courts, 4- the fact that it shows just how unprepared Republicans are for what should be one of their greatest ever victories, 5- more things that I can’t think of just right now.

As a pro-life person, I could see only positives even for the liberals as they think that they are going to suffer their greatest loss. But I don’t have time to get into the whole abortion issue as much as I’d like to in this post as it is already past the time this should have been published.

Still, you do have to wonder how someone was able to leak this news and who did it. I think that the most likely explanation was that it was a law clerk for Alito since all signs point to this being one of his opinions being leaked. It could be someone of either party. And it is interesting that this will now be out before a whole lot of the primaries have happened whereas a lot of them would have happened normally without this news.

The obvious solution to this story originally was that it was fake and someone was stirring up a lot of trouble. But this isn’t the case as John Roberts confirmed that it was true. Still, we will have to wait to see if the court will go with this leak instead of anything else. There was clearly a lot of pressure to either 1- make sure that the court stays in line or 2- try to get the court to change out of this opinion.

We don’t even know yet if this leak violates the law. It is possible that it doesn’t, although there is a chance that it does. There is still a lot of uncertainity with the vote until it is made official. It is interesting that Republicans are only focused on talking about the leak and not what should be one of their greatest victories which they wanted since the 1970s when Roe was decided in the first place. It will also be interesting to see how abortion crime would be implemented. I know that Trump got a lot of crap for saying that if abortion were illegal, people should be punished for it, but any crime should have a punishment. The question is what would be a good and just one that is right.

There’s still a lot of uncertainty about this as stuff will change over time. We’ll see if the case does wind up being decided against abortion overturning Roe. I might want to do some more posts about abortion such as a YouTube video (or series of them) talking about why I feel that it is wrong. If only could convince me that it doesn’t end a life, I would be pro-choice. No one is ever going to convince me of that, but you are more than free to try. Meanwhile, I look forward to see this backfire spectularily on Republicans as they aren’t ready for the shitstorm that is going to happen if the leak is confirmed in the decision.
